Terms of Service
Effective: 28 September 2026
First published version, seeded from the platform legal template.
1. General
1.1 Uplinkd Group Pty Ltd (ABN 50 660 968 123) ('Pointbreak & Co', 'we', 'us' or 'our') operates and maintains the pointbreakandco.com website, referred to as the Service.
1.2 These terms apply to your access to and use of the Service. By accessing or using the Service, you agree to these terms. If you do not agree, do not use the Service.
1.3 We may change these terms at any time by publishing the changed terms on this website. The effective date at the top shows the version in force, and every earlier version stays published beneath it. Changes do not operate retrospectively.
1.4 These terms are governed by the laws of Victoria, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of Victoria, Australia. We do not warrant that the Service or its content complies with the laws of any other jurisdiction. If you access the Service from outside Australia, you do so at your own risk.
2. Services
2.1 The Service is the pointbreakandco.com website, as described on this website.
2.2 The membership gives you access to the member-only content and tools published on the site for as long as your membership runs. What the membership includes when you join is described on the pricing page. Changes to the membership are covered by clause 4.6.
3. Accounts, usernames and passwords
The site does not offer user accounts. [OWNER TO CONFIRM] If an account feature is introduced, this section will set out eligibility, credentials and closure.
4. Membership
4.1 Pointbreak & Co offers one membership, billed annually. The current price is shown on the pricing page and at checkout. There is no free plan beyond the trial in clause 4.2.
4.2 Free trial. A new membership starts with a 7-day free trial. A payment card is required to start the trial and nothing is charged during it. We email you 3 days before the first charge. If you cancel before the trial ends you are not charged. If you do not cancel, the plan you chose is charged when the trial ends and renews each year until you cancel.
4.3 Renewal. The membership renews automatically at the end of each paid year, until you cancel.
4.4 Cancellation by you. You may cancel at any time from your account page, where that option is shown, or by emailing [OWNER TO CONFIRM] contact address. Cancellation takes effect at the end of the current paid period: you keep access until then and no further charge is made. Refunds are covered by the Refund Policy in clause 5.3.
4.5 Member content. Access to member-only content and tools is personal to you and non-transferable. You may use it for your own purposes for as long as your membership runs. You must not resell it, share your login or redistribute member-only content.
4.6 Changes to the membership. We may change what the membership includes. We give at least 30 days' notice of a change that materially reduces what a paid membership includes. If you do not agree with the change, you may cancel under clause 4.4.
5. Payments and our fees
5.1 We charge for the membership. Our fees are calculated in accordance with our published pricing, found on our website. If any tax, impost, duty or charge applies to our provision of the Service to you, you must pay this in addition to our fee, unless we say otherwise in writing. Applicable taxes, including Australian GST where it applies, are shown at checkout before you pay. [OWNER TO CONFIRM] State whether the entity is registered for GST and whether the prices shown include it.
5.2 We may change our fee structure at any time by publishing a revised version, but changes will not apply retrospectively. A changed fee applies to your membership from its next renewal after the change is published.
5.3 Our cancellation and refund policies are set out on our website: cancellation in clause 4.4 of these terms and refunds in our Refund Policy. Where a membership is cancelled, we act in accordance with them.
5.4 Payments are processed by Stripe under its own terms. We do not store your card details.
5.5 All of our fees are expressed and charged in either AUD or USD as displayed. Memberships and other purchases made on this website are charged in US dollars.

(a) the Service is provided on an 'as is' basis and we exclude all implied conditions, warranties, guarantees and representations of any kind;
(b) where any law implies a condition, warranty or guarantee into these terms which cannot be excluded, our liability for breach of it is limited, at our election, to the resupply of the Service or the payment of the cost of resupply; and
